Agreement to Terms
Welcome to The Beauty Exchange. These Terms of Service ("Terms") govern your access to and use of our website and mobile application (collectively, the "Platform"), operated by The Beauty Exchange ("we," "our," or "us").
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.
Description of Service
The Beauty Exchange is a platform that connects individuals seeking beauty services ("Seekers") with independent beauty professionals ("Providers"). We facilitate discovery, communication, and reviews between Seekers and Providers.
We do not provide beauty services ourselves. Providers are independent contractors, not employees of The Beauty Exchange. We are not responsible for the quality, safety, or legality of services provided by Providers.
Account Registration
To use certain features of the Platform, you must create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use of your account
You must be at least 18 years old to create an account and use the Platform.
User Conduct
You agree not to engage in any of the following prohibited activities:
- Violating any applicable laws or regulations
- Posting false, misleading, or fraudulent content
- Harassing, threatening, or intimidating other users
- Impersonating any person or entity
- Interfering with the proper functioning of the Platform
- Attempting to gain unauthorized access to the Platform or other accounts
- Using the Platform for any illegal or unauthorized purpose
- Posting content that infringes intellectual property rights
- Spamming or soliciting users for purposes unrelated to the Platform
Provider Terms
If you register as a Provider, you additionally agree to:
- Provide accurate information about your services, qualifications, and pricing
- Maintain any required licenses, permits, or certifications
- Comply with all applicable health, safety, and sanitation regulations
- Carry appropriate insurance for your services
- Honor appointments and communicate professionally with Seekers
- Not discriminate against Seekers based on protected characteristics
You acknowledge that you are an independent contractor and not an employee, partner, or agent of The Beauty Exchange.
Reviews and User Content
Users may post reviews, photos, and other content ("User Content") on the Platform. By posting User Content, you:
- Grant us a non-exclusive, royalty-free license to use, display, and distribute your content
- Represent that you own or have the right to post the content
- Agree that your content does not violate any third-party rights
- Understand that reviews should be honest, accurate, and based on actual experiences
We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, without prior notice.
Intellectual Property
The Platform and its original content (excluding User Content), features, and functionality are owned by The Beauty Exchange and are protected by copyright, trademark, and other intellectual property laws.
Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
WE DO NOT ENDORSE, WARRANT, OR GUARANTEE ANY PROVIDER OR SERVICE OFFERED THROUGH THE PLATFORM. ANY TRANSACTIONS OR INTERACTIONS BETWEEN SEEKERS AND PROVIDERS ARE SOLELY BETWEEN THOSE PARTIES.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE BEAUTY EXCHANGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
Indemnification
You agree to indemnify, defend, and hold harmless The Beauty Exchange and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Platform or violation of these Terms.
Termination
We may terminate or suspend your account and access to the Platform at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
